1. Agreement to these terms
By using this website, creating an account, or ordering services, you accept these Terms of Service and the policies linked here (notably the Acceptable use policy, Privacy policy, and Refund & cancellation policy). We may change terms with reasonable notice; material changes to paid services are communicated through email or the client area. Continued use after changes are posted and notified constitutes acceptance, except where a stricter process is required by law.
2. Services and acceptable use
HostStack provides web hosting (shared and cloud) and virtual private servers as described in your order, plan pages, and product descriptions at checkout. You must not use the services in ways that violate the AUP, applicable Indian law, export controls, or third-party rights. We may suspend, throttle, or terminate accounts that endanger the network, send unsolicited bulk email, or host illegal, fraudulent, hateful, or non-consensual content.
3. Your account, password, and data
You are responsible for maintaining the confidentiality of credentials, for the actions taken through your account, and for keeping your own off-site backups of critical data even when the plan includes server-side backups. You grant HostStack a limited licence to host, copy, and process your data solely to perform the service and as described in the Privacy policy. You must provide accurate contact information; we use it for security alerts, legal notices, and service updates that affect billing or availability.
4. Payment, renewals, and taxes in India
Fees are in INR unless stated otherwise, plus applicable taxes. Promotional prices, where offered, are limited to the period shown. Services renew on the published cycle (monthly, annual, and so on) at the then-current renewal rate unless you cancel in advance through the client area or a documented self-service process. You authorise us and our payment partners to charge your selected method, including for renewals, until you cancel. Failure to pay may lead to suspension or data deletion after a reasonable grace period specified in the service description.
5. Warranties and limitations
Services are provided on an “as is” and “as available” basis to the maximum extent allowed by law. We target 99.9% availability in line with the broader industry, but the internet and third parties are not under our full control. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or lost profits, or for your reliance on the service for life-safety, medical, or other ultra-high-stakes use cases not intended for general-purpose hosting. Your exclusive remedy in many cases is described in the refund policy (including where limited exceptions apply), or a service credit that we will specify in writing for long-duration outages that exceed published eligibility.
6. Law and contact
These terms are intended for Indian customers and India-focused marketing. Disputes are ideally resolved in good faith: email [email protected] or WhatsApp with a clear summary. Governing law and forum selection should match your final executed agreement at checkout; this page is a plain-language overview to support navigation from our homepage and the hosting product line.
7. Prohibited uses in plain language
You will not resell, sublicense, or rent the control panel in ways that break our licence, reverse engineer the management layer, or use automated tools to map our internal network where that creates risk. You will not attempt to break into other customers’ sites on shared hardware, to bypass authentication to our or third-party systems, or to mine cryptocurrency in ways that are disallowed in your AUP. If you are unsure whether a use case (crypto nodes, public proxies, mass mailing) is allowed, ask before you build on production plans.
8. DMCA-style notices and copyright
We respect intellectual property. If you believe a customer site infringes, send a detailed notice to our abuse inbox with: your contact, the work claimed, the allegedly infringing URL, a good-faith statement, and a declaration of accuracy. We will follow an appropriate process, which may include notification to the customer, temporary restriction, and removal in clear violation cases, subject to counter-notice and applicable law. Filing a false report may have consequences under Indian law. This section exists so search engines, brand owners, and honest operators share the same clear escalation path instead of ad-hoc arguments on social media.
